Left employment a year ago: can I still claim?
I left my employment with a local authority one year ago. I have now learned that former colleagues of mine have received equal pay awards. Can I claim?
The general rule is that if you have an equal pay claim, you must raise a formal grievance with your former employer within six months of leaving their employment. You then have an additional three months in which to bring a claim in the Employment Tribunal.
If you left your employment a year ago you will be out of time in which to bring a claim unless you can successfully argue that the existence of your claim was deliberately concealed from you by your employer.
If it was deliberately concealed the six month period for raising a grievance does not start until the date that you could reasonably have been expected to have been aware that you had a claim.
