Equal pay claim: do I have to accept the union settlement if it is less than I am due?

Along with my colleagues, I have an established Equal Pay claim which has been accepted by my employers. My Union has advised me of the settlement offer, which is £4000 but this is a lot less than my real entitlement. Do I have to accept this?

You are under no obligation to accept a sum lower than that to which you are entitled irrespective of what your Union has agreed. If you wish to pursue your full claim, you should commence a grievance procedure with your employer and, thereafter pursue proceedings at an Employment Tribunal if the Grievance does not resolve with a satisfactory outcome.
